Delivery Disclosures

By placing an order with BORAGOLD LLC (“BORAGOLD,” “we,” “us,” or “our”), the customer (“Customer,” “you,” or “your”) acknowledges and agrees to the terms below. These terms apply to purchases made through our website, by telephone, through social media, or through another sales channel operated by BORAGOLD.

1. Product Information

BORAGOLD sells gold, silver, and other jewelry and related products. We make reasonable efforts to accurately describe each item, including its karat, approximate weight, dimensions, condition, and other relevant characteristics.

Jewelry weights and measurements may vary slightly because of normal manufacturing tolerances, sizing, finishing, repairs, polishing, or measurement differences.

Photographs are provided for identification and presentation purposes. Colors, proportions, finishes, and appearance may vary depending on lighting, photography, screen settings, and the customer's device.

Unless specifically stated otherwise in the product listing or purchase agreement, photographs may not represent the exact physical size of an item.

The product description and the completed Purchase Agreement control if there is a material difference between general website content and the specific terms of a transaction.

2. Gold and Precious-Metal Disclosure

Gold jewelry will be identified by its represented karat or fineness when known and applicable.

The market price of gold, silver, and other precious metals changes continuously. A subsequent increase or decrease in the market value of the metal does not change the agreed purchase price after BORAGOLD accepts an order.

The retail price of jewelry is not based solely on its precious-metal melt value. Retail prices may reflect manufacturing, design, workmanship, sourcing, stones, brand, condition, overhead, market demand, and other factors.

BORAGOLD does not guarantee that an item's future resale, trade-in, or scrap value will equal or exceed its purchase price.

Jewelry purchased from BORAGOLD should not be considered an investment product or a guarantee of financial return.

3. Order Acceptance

Submitting an order does not necessarily constitute final acceptance by BORAGOLD.

BORAGOLD may verify product availability, payment information, customer information, shipping information, identity, and other information reasonably necessary to complete the transaction.

An order may be rejected or cancelled if the item is unavailable, information cannot be verified, payment is declined, fraud is suspected, a pricing or listing error occurred, or BORAGOLD reasonably determines that the transaction cannot be completed.

If BORAGOLD cancels an order after collecting payment, amounts due for refund will be returned according to the applicable refund terms and payment-processing requirements.

4. Pricing and Payment

The Customer agrees to pay the price displayed or otherwise agreed to at the time BORAGOLD accepts the order, together with applicable taxes, shipping charges, processing charges, or other charges disclosed before completion of the transaction.

BORAGOLD may change prices at any time before an order is accepted.

A price change after purchase does not entitle the Customer to a refund, price adjustment, or additional charge unless required by applicable law or specifically agreed to by BORAGOLD.

5. Payment Authorization

By providing a payment method, the Customer represents that the Customer is authorized to use that payment method and authorizes BORAGOLD and its payment-processing providers to process the amounts disclosed for the transaction.

Financial institutions may temporarily place authorization holds on funds. The timing for releasing an authorization hold is generally controlled by the Customer's financial institution and payment network rather than BORAGOLD.

6. Delivery and Shipping

Estimated delivery dates are estimates and are not guaranteed unless BORAGOLD expressly agrees otherwise in writing.

Delivery may be affected by inventory availability, payment verification, carrier schedules, weather, holidays, transportation disruptions, incorrect addresses, security reviews, manufacturer or supplier delays, or circumstances outside BORAGOLD's reasonable control.

BORAGOLD is not responsible for delays caused by shipping carriers or circumstances outside BORAGOLD's reasonable control, except where applicable law provides otherwise.

Customers are responsible for providing a complete and accurate delivery address before shipment.

Additional charges resulting from an incorrect address, refused shipment, unsuccessful delivery attempt, or customer-requested redirection may be charged to the Customer where permitted by law.

BORAGOLD may require tracking, insurance, adult signature, identification, or signature confirmation for jewelry shipments.

7. Inspection Upon Delivery

The Customer should inspect the package and jewelry promptly after delivery.

If an item arrives damaged, materially different from the item ordered, or appears to have been lost, opened, substituted, or damaged during transportation, the Customer should notify BORAGOLD promptly and preserve the item, packaging, shipping label, photographs, tracking information, and other relevant evidence.

BORAGOLD may require photographs, video, carrier documentation, identification, or return of the merchandise before approving a replacement, refund, insurance claim, or other remedy.

Nothing in this section eliminates rights or remedies that cannot legally be waived.

8. Returns, Cancellations and Refunds

Return and refund eligibility is governed by BORAGOLD's Return & Refund Policy in effect when the order is placed and any transaction-specific terms disclosed before purchase.

Items that have been worn, damaged, altered, resized, engraved, customized, repaired by another party, or otherwise changed after delivery may be ineligible for return except where required by law.

Custom-made, personalized, specially ordered, engraved, resized, or otherwise modified jewelry may be final sale when this is disclosed before purchase and permitted by law.

Shipping, processing, customization, resizing, or other charges may be nonrefundable when properly disclosed and permitted by law.

Approved refunds will normally be issued to the original payment method unless otherwise agreed or required by law.

BORAGOLD is not responsible for the time a financial institution takes to post an approved refund after BORAGOLD processes it.

9. Customer Information

The Customer represents that information supplied to BORAGOLD in connection with an order is accurate and complete.

BORAGOLD may take reasonable steps to verify information supplied by the Customer for fraud prevention, transaction processing, delivery, account servicing, and other legitimate business purposes.

Providing false, misleading, incomplete, or fraudulent information may result in cancellation or rejection of an order and may result in other lawful action when appropriate.

Customer information will be handled according to BORAGOLD's Privacy Policy and applicable law.

10. Electronic Communications

By providing an email address or telephone number, the Customer agrees that BORAGOLD may use that information to communicate regarding orders, deliveries, payments, account servicing, customer-service requests, fraud prevention, or other transactional matters.

Marketing communications will be handled according to applicable consent and opt-out requirements.

Consent to receive marketing communications is not a condition of purchasing jewelry unless expressly permitted by applicable law.

11. Fraud Prevention

BORAGOLD reserves the right to delay, decline, cancel, or request additional verification for transactions that reasonably appear suspicious, unauthorized, fraudulent, or inconsistent with information supplied by the Customer.

BORAGOLD may cooperate with payment processors, shipping carriers, insurers, financial institutions, and law-enforcement authorities regarding suspected fraud, theft, chargebacks, or unauthorized transactions as permitted by law.

12. Chargebacks and Payment Disputes

Customers should contact BORAGOLD promptly if they believe a billing error or transaction problem has occurred.

BORAGOLD reserves the right to provide transaction records, order confirmations, communications, delivery confirmation, photographs, signed documentation, tracking information, and other relevant evidence to financial institutions or payment processors when responding to a payment dispute or chargeback.

Nothing in these terms limits a Customer's lawful rights to dispute an unauthorized or improper transaction.

13. Jewelry Care and Damage

Gold and other jewelry can scratch, bend, break, tarnish, stretch, lose stones, or otherwise become damaged through normal wear, impact, chemicals, improper storage, misuse, or inadequate maintenance.

BORAGOLD is not responsible for damage occurring after delivery because of misuse, accidents, improper care, unauthorized repairs or modifications, or ordinary wear and tear, except to the extent covered by an express warranty or required by law.

14. Stones and Jewelry Characteristics

Natural and manufactured jewelry products may have variations in color, texture, dimensions, finish, stone characteristics, or appearance.

Any diamond, gemstone, laboratory-grown stone, simulated stone, or other material will be described according to the information BORAGOLD reasonably has available and any disclosures applicable to the specific product.

A stone should not be assumed to be natural, laboratory-grown, treated, untreated, or of a particular grade unless the product description or accompanying documentation specifically states that characteristic.

15. No Guarantee of Future Value

BORAGOLD makes no guarantee concerning future gold prices, jewelry appreciation, resale prices, pawn value, trade-in value, or scrap value.

Customers purchase jewelry for the product itself under the terms of the transaction and should not rely on statements regarding potential future value unless those statements are expressly incorporated into a written agreement.

16. Limitation of Liability

To the maximum extent permitted by applicable law, BORAGOLD will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from a transaction or use of merchandise.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. Force Majeure

BORAGOLD will not be responsible for delays or failures caused by events outside its reasonable control, including severe weather, natural disasters, carrier interruptions, governmental actions, labor disruptions, transportation failures, widespread technology outages, or similar events, subject to applicable law.

18. Governing Law

These terms and transactions with BORAGOLD are governed by applicable federal law and the laws of the State of Georgia, without eliminating any consumer protection that applicable law does not permit the parties to waive.

19. Entire Transaction

The product listing, order confirmation, Purchase Agreement, applicable policies, and any transaction-specific written terms accepted by the Customer constitute the terms applicable to the purchase.

If a transaction-specific signed or electronically accepted agreement conflicts with general website terms, the transaction-specific agreement controls to the extent permitted by law.

20. Severability

If any provision of these terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

21. Customer Acceptance

By completing a purchase, electronically accepting an agreement, or otherwise indicating acceptance where provided, the Customer acknowledges that the Customer had an opportunity to review the applicable transaction terms before completing the purchase.


SEPARATE TRANSACTION TERMS

BORAGOLD may separately offer a rental-purchase or rent-to-own option on eligible merchandise.

Current new offers are limited to 6-month or 8-month terms with weekly or biweekly payments. The initial payment plus the disclosed $10 processing fee is due when a new agreement begins. These current website options apply only to new offers and do not modify any already-executed Rental-Purchase Agreement.

A rent-to-own transaction is separate from a standard cash purchase and is governed by the specific Rental-Purchase Agreement provided to the Customer.

The Rental-Purchase Agreement should disclose the initial payment, recurring payment amount, payment frequency, rental term, total amount necessary to acquire ownership, applicable fees, early-purchase provisions, renewal requirements, late-payment provisions, return rights, ownership conditions, and other legally required disclosures.

**Ownership does not transfer merely because the Customer takes possession of merchandise under a rental-purchase arrangement. Ownership transfers only according to the terms of the applicable Rental-Purchase Agreement.**

Customers should review the entire Rental-Purchase Agreement before accepting merchandise.

BORAGOLD does not represent that rent-to-own will be the least expensive method of acquiring jewelry. The total amount paid under a rental-purchase arrangement may be greater than the cash purchase price.

Any statement such as “no credit needed,” “no credit check,” “same as cash,” or similar financing or rental-purchase representation applies only when specifically offered and described in the applicable agreement.
